Terms of Service for TrimCargo
These terms govern your use of the TrimCargo Android, iOS and Windows applications. By installing or using a TrimCargo app, you agree to these terms.
Verify every result against the vessel’s approved stability booklet, hydrostatic tables, loading manual, company procedures and applicable regulations before acting.
1. About TrimCargo
TrimCargo is a professional decision-support tool for marine cargo officers, surveyors and ship operators. It assists with draft surveys, hold trimming, loading-limit checks, list and heel calculations, voyage record-keeping and related cargo computations.
2. Eligibility
The apps are intended for adult professional users who have appropriate marine training. By using an app, you confirm that you meet these criteria.
3. Licence
You receive a personal, non-exclusive, non-transferable and revocable licence to install and use the apps on devices you own or control for professional use. You may not unlawfully reverse engineer, remove proprietary notices, sublicense, rent, resell or use the apps in violation of applicable law or vessel-management policy.
4. Vessel data and outputs
You are responsible for the accuracy of all vessel, hydrostatic, hatch, draft, density, ballast, fuel, cargo and other values entered into the apps. Calculations are only as accurate as the input and source documentation provided.
5. Trial and TrimCargo Pro
A verified account may receive a single 14-day trial shared across supported platforms. TrimCargo Pro — All Platforms is intended as a one-time, non-consumable purchase rather than a subscription. The applicable store controls payment processing, displayed regional pricing, receipts, refunds and restoration. Access may be withdrawn when a transaction is refunded, cancelled or revoked.
6. Transfers and cloud workspace
You may manually transfer supported voyage archives and vessel Master CSV files. Voyage archives are encrypted; Master CSV files are readable operational data. Optional cloud transfer is user-initiated, creates separate downloaded copies and does not replace your responsibility to maintain suitable records and confirm revisions.
7. No warranty
The apps are provided “as is” and “as available”, without warranties of accuracy, completeness, merchantability, fitness for a particular purpose or uninterrupted operation, to the fullest extent permitted by law.
8. Limitation of liability
To the fullest extent permitted by law, the operator is not liable for indirect, incidental, consequential, special or punitive loss arising from use of, or inability to use, the apps, including cargo loss, vessel damage, business interruption, loss of data, demurrage, fines or third-party claims. Rights that cannot be excluded under Australian Consumer Law remain unaffected.
9. Privacy
Use of the apps is also governed by the TrimCargo Privacy Policy.
10. Updates and termination
Updates may add, change or remove features. The licence terminates if you materially breach these terms. Provisions concerning data responsibility, warranty, liability, privacy and governing law survive termination.
11. Governing law and stores
These terms are governed by the laws of Australia. Store terms also apply when an app or purchase is obtained through Google Play, Apple’s App Store or Microsoft Store. Mandatory consumer rights prevail where applicable.
